The following Terms and Conditions apply in all circumstances when we have been instructed to move a vehicle, whether that be a verbal or written instruction, with or without an order number.
Calls may be recorded for training and monitoring purposes to help improve the service Motor Trade Logistics provide to our customers.
All vehicles Motor Trade Logistics move, or are in possession of, are fully insured under our “A” rated insurance policy.
Our Public Liability is £10,000,000 and our Road Risk for a vehicle being Driven is £100,000. (Provisions can be made for any vehicle above £100,000 but you will need to stipulate this when making the booking)
Motor Trade Logistics DO NOT use agency or temporary staff not associated with Motor Trade Logistics.
ALL delivery agents are carefully handpicked and trained by Motor Trade Logistics.
It is the duty of the customer to ensure that all vehicles to be moved by Motor Trade Logistics are roadworthy and have a current/valid MOT at the time the vehicle is due to be moved by Motor Trade Logistics.
Our delivery agents expect to be on site awaiting a collection no longer than 30 minutes. Waiting time is charged to the booking dealer/customer at a rate of £15.00 + VAT per 30 minutes after the initial 30 minutes has lapsed. The charge is made due to the delay in the delivery agents time along with the knockon effect of the amount of scheduled jobs that the delivery agent needs to complete.
If the vehicle requires a charge en-route due to not being able to complete the journey then a waiting time fee of £30.00 + VAT will apply. This fee is NOT associated to the amount of electricity the vehicle requires, it is for WAITING TIME taken for a charge point to become available and the WAITING TIME associated while the vehicle is being charged. The cost to charge the vehicle via a charging terminal is treated in the same manner as fuel and is chargeable, the receipt(s) will be photographed and sent to your registered email address upon completion of the job. Please be mindful that some vehicles may require multiple charges per journey and the vehicle may have additional miles added should the delivery agent have to go off route to find a charging terminal.
Like most Motor Trade insurance policies, our insurance does not cover punctures, glass damage or damage from road debris. This is deemed to be no fault of the Motor Trade Logistics delivery agent as the damage would occur with whoever was in charge of the vehicle.
While the vehicle is under the control of Motor Trade Logistics, we are responsible for any of the above. Due to covert cameras, the delivery agent generally has no idea if he/she has exceeded a speed limit or has overstayed in a car park. In any event, the registered keeper WILL receive the enforcement notice relating to the offence.
It is imperative that the person that receives the notice or summons complies with the law and fill in the relevant section on the fine or the enforcement notice stating that they were NOT in control of the vehicle at the time of the offence, this is generally section B or section 2.
Motor Trade Logistics will honour their responsibilities to pay any of the above offences as long as the request for information has been completed by the registered keeper in a timely manner. If the notice has been ignored and the fine has been escalated, Motor Trade Logistics will only be responsible for the original charges relating to the offence.
PLEASE NOTE:
Although the original offence may have been caused by an agent of Motor Trade Logistics, unless the registered keeper of the vehicle has absolved his/her liability by completing the relevant section on the enforcement notice they will always be liable under English Law.
When you instruct us to move a vehicle, we also make a record of the exterior condition on a vehicle condition sheet that both parties sign. All of our delivery agents are trained to report on a vehicle’s cosmetic condition. If our delivery agent has misreported on the condition sheet a physical defect to the vehicles exterior then the responsibility WILL be with Motor Trade Logistics.
On Collection if the vehicle is inspected in poor weather/light conditions, or is excessively soiled, it may not be possible to produce an accurate inspection report. This will be noted on the digital condition report and in these circumstances Motor Trade Logistics will not be responsible for damage subsequently identified.
Our delivery agent will ask you to sign a vehicle condition report on delivery of the vehicle to you. Once the vehicle has been inspected and the vehicle condition report has been signed by you or by a representative of your company Motor Trade Logistics will have no further liability and cannot be held liable for its condition or be responsible for any future claims as to its roadworthiness, mechanical or cosmetic condition.
Motor Trade Logistics, its delivery agents, staff and employees cannot give any guarantees. Vehicle condition reports or vehicle appraisals are based on the opinions of the delivery agent following a visual assessment as to the condition of the vehicle at the time of the inspection.
If the purchaser/buyer has requested a telephone appraisal, it is the purchaser/buyer’s responsibility to ask the delivery agent to check items that are standard or non-standard items. The purchaser/buyer may ask our delivery agent to check the V5, number of keys, and service books/histories. Where a road test is conducted the report is based on the opinions of the delivery agent in the limited time allowed to get the vehicle up to the normal operating temperature.
If it has been agreed that Motor Trade Logistics has a responsibility to pay for any rectification, those charges must be supported by a bona fide invoice and be invoiced at cost price. On production of a bona fide invoice at cost price your invoice will be paid within 14 days. (We may require photographic evidence of the completed rectification).
Where breakdown cover has not been taken out and a breakdown occurs, £100.00 plus VAT or £1.60 a mile plus VAT, whichever is the higher, will be charged to get the vehicle to its onward destination. Any chargeable parts/lubricants required by the breakdown agent to ensure the onward movement for the job to be completed are chargeable to the Customer.
Motor Trade Logistics cannot be held responsible for the mechanical condition of a vehicle that they have been instructed to move or for any mechanical defect encountered whilst the vehicle is in transit.
A delivery agent will rely on the accuracy of a vehicle’s warning lights or a multi-function display and will take all reasonable measures to protect himself/herself and the vehicle being moved.
Our delivery agents are instructed to find a safe and suitable area to pull over should the vehicle encounter a fault. In the case of a motorway/smart motorway, this is likely to be the next services/refuge area.
In the event of the vehicle needing fuel, the delivery agent will obtain an official receipt, photographed copies with the proof of delivery documents will be sent when the vehicle has been delivered.
Where a Vehicle movement is cancelled less than 24 hours prior to the booked date of the movement the full job cost will be charged.
If you are not an account holder you can pay for movements as you require them. If you have an account with Motor Trade Logistics our invoices are due no longer than 30 days after the invoice has been raised, jobs are invoiced by our system the week they are completed. If an agent or representative from your company has instructed us (verbally or written) to complete a movement but has not supplied us with an order number the invoice is still due on the due date.
